Abstract

The authors of the article consider a leasing agreement, which is a "symbiosis" of two natures: economic and legal. This specificity is the main reason for the difficulty of studying leasing. The versatility of leasing has generated many disputes in Russian judicial practice.

Since 2023, the Russian Federation has begun to actively use leasing as a specific financial instrument that allows entrepreneurs to "stay afloat".

The authors of this work consider the legal problems arising within the framework of leasing relations, such as the problems of determining the nature of leasing and the subject of the leasing agreement, and also propose ways to solve these problems.

Through all the work, the authors conclude that leasing in modern realities causes a lot of controversy.

The implementation of the author's proposals will contribute to unambiguity in solving at least a few practical issues in the field of leasing activities.
